If a product is dangerous, you may have a legal case

When a product is made with defects or is potentially hazardous without the appropriate warnings, a manufacturer or seller could face product liability lawsuits. As there have been many lawsuits like this in the history of the United States, you may have a case if you're hurt because a product that was not working as intended.

There are three kinds of product defects — design, manufacturing and marketing. Design defects lead to a product being unsafe because of problems with the design from the very beginning.

Manufacturing defects are different, because the design itself may have been safe. However, during the course of manufacturing, the product was altered or made defective in some way.

The third issue is called a marketing defect. This happens when a product is marketed improperly, e.g., by providing insufficient instructions or not providing the safety warnings that should have been included.

Some products are going to be unsafe no matter what, like knives, guns, hot hair tools and others. In those cases, it's very important for the company to provide the appropriate warning labels, so you can read about the dangers of using the product and how to mitigate the risk to yourself and others.

What happens if you're hurt because a product is defective?

If you are injured because of a defective product, you may be able to seek legal assistance and make a claim for damages. You may be able to pursue a claim against the manufacturer, wholesaler, retail store or other party involved in the production or sale of the defective product.
