Understanding the lack of distracted driving laws in Montana

Whenever you get behind the wheel, your focus should be on the road. At Cok Kinzler PLLP, we have seen all too often what can happen when people are distracted. In order to stay safe, you should know what Montana’s laws are regarding cellphone use while driving and which behaviors constitute a distraction.

According to, Montana does not have any laws in place that regulate the practice of using a phone while driving. This year, a bill was introduced in the state legislature to ban motorists from using a phone, but lawmakers failed to pass it. Montana is the only state in the country without some type of cellphone regulation. There are, however, five cities in the state that have issued ordinances against cellphone use: Whitefish, Missoula, Helena, Butte and Billings.

According to the Montana Highway Patrol, there were 1,614 distracted driving-related crashes across the state between 2004 and 2013. It is important to note that while talking or texting on a phone is perhaps the most widely discussed and legislated distraction, there are other behaviors that can dangerously take a driver’s focus off the road, such as the following: 

  •        Eating
  •        Grooming
  •        Reaching for something in the car
  •        Talking to a passenger
