Understanding CTE

Concussions and the growing understanding of their effects on people may be a hot topic of conversation between people in Bozeman and throughout the rest of the U.S. This may be due to the recent identification of chronic traumatic encephalopathy as a condition that may affect those who’ve suffered several incidents involving head trauma. Yet despite its name being thrown around in news reports, many may still not completely understand what CTE is and who may be likely to suffer from it.

Understanding the burden of proof

If you have seen a family member or friend from Bozeman die due to the negligence or wrongful actions of another, your hope may be that whomever is responsible faces criminal penalties. Yet what if such parties do not? Many come to us here at Cok Kinzler PLLP after such acquittals thinking that they no longer have a basis on which to initiate civil action. If you share this same opinion, you may be happy to learn that you are wrong.

Metal fragments in smokeless tobacco cans prompts recall

Many in Bozeman may wonder how it is that the manufacturers of products that have been shown to present the potential for harm to consumers (such as products containing tobacco or alcohol) are able to avoid liability for their use. The reason why is that such companies meet the standard of warning consumers about the possible dangers their products pose. Including warnings on cigarette packs or marketing alcohol with phrases encouraging people to drink responsibly serves to inform consumers, who then may be viewed as accepting a product’s risks. However, manufacturers may not be immune from blame for other factors which may cause these products to harm users.

Understanding right-of-way laws in Montana

If you are like most in Bozeman that have significant experience on the road, then you likely believe that you have a strong understanding of the state’s traffic laws. Yet many of those who come to us here at Cok Kinzler PLLP often think that those regulations are limited to how fast you should drive and whether or not you are legally required to wear your seatbelt. However, in many cases, simple matters such a misunderstanding over right-of-way can often lead to collisions. If you have been involved in such an accident, you should know what the right-of-way laws in Montana are to determine liability.
